Terms of Service

Note: This is a translation provided for your convenience. In case of any discrepancy between this translation and the Portuguese version, the Portuguese version shall prevail.
Welcome to Monely! These Terms of Service ("Terms") establish the conditions for using our personal finance management app ("Service", "App" or "Monely"). By creating an account or using Monely, you agree to these Terms.
Please read these Terms carefully before using the Service. If you do not agree with any condition, do not use the App.
1. Acceptance of Terms
By accessing or using Monely, you confirm that:
- You have read, understood and agree to these Terms of Service;
- You have read and agree to our Privacy Policy;
- You have the legal capacity to enter into this agreement;
- You are at least 18 (eighteen) years old.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of the Service
Monely is a personal finance management app that allows you to:
- Record income and expenses manually or by voice;
- Record transactions via WhatsApp with an AI assistant;
- Scan receipts and invoices for automatic recording;
- Organize transactions by categories, labels and accounts;
- Set and track financial goals;
- View reports and charts about your finances;
- Chat with an AI assistant for personalized financial insights (subject to consent);
- Receive daily AI-generated insights about your financial habits (subject to consent);
- Share expenses with groups (optional);
- Sync data across devices.
Important: Monely is a financial organization tool. We are not a financial institution, we do not offer credit, investments or banking services, and we do not automatically connect to your bank accounts.
3. Plans and Pricing
3.1 FREE Plan
Monely offers a free plan with the following features:
- Up to 2 (two) bank accounts;
- Up to 50 (fifty) transactions per month;
- Up to 20 (twenty) WhatsApp (AI) entries per month;
- Default system categories;
- Labels and templates;
- Financial goals;
- Charts and reports;
- Cloud backup;
- Cross-device sync;
- No ads.
3.2 PRO Plan
The PRO plan offers expanded features through a paid subscription:
- Unlimited bank accounts;
- Unlimited transactions;
- Unlimited WhatsApp (AI) entries;
- Custom categories;
- All FREE plan features.
3.3 Pricing
Current PRO plan prices are:
- Monthly: R$ 14.90 per month;
- Annual: R$ 149.00 per year (equivalent to R$ 12.42 per month).
Prices may be changed at any time, with 30 (thirty) days prior notice. Price changes will not affect subscriptions already in effect until the next renewal cycle.
3.4 FREE Plan Limits
Transaction and AI entry limits reset on the first day of each month. When you reach the limit, you will be notified and can upgrade to the PRO plan or wait until the next month to continue using the free service.
4. Subscriptions and Payments
4.1 Payment Method
PRO plan payments are processed exclusively through official stores:
- Google Play Store for Android devices;
- App Store for Apple devices (iPhone/iPad).
Available payment methods are those accepted by the respective stores, which may include credit card, debit card, bank slip, Pix or store credits.
4.2 Automatic Renewal
Subscriptions are automatically renewed at the end of each period (monthly or annual), unless you cancel before the end of the current cycle. Billing is done automatically by the corresponding store (Google Play or App Store).
4.3 Cancellation
There is no commitment. You can cancel your subscription at any time through the store settings (Google Play or App Store). Upon cancellation:
- You keep access to the PRO plan until the end of the already paid period;
- After expiration, your account automatically reverts to the FREE plan;
- Your data is kept, but subject to FREE plan limits;
- You can upgrade again at any time.
4.4 Refund
Refund policies are determined by the official stores (Google Play and App Store). Refund requests should be made directly through the store where the purchase was made. Monely does not process refunds directly.
4.5 Plan Change
When changing from PRO to FREE plan (by cancellation or non-renewal), if you have more resources than allowed in the free plan (e.g., more than 2 accounts), your data will be kept, but you will not be able to create new records until you comply with the FREE plan limits.
5. Early Adopter Program
5.1 Description
The Early Adopter Program is an exclusive offer for users who sign up during Monely's Beta phase. Eligible participants receive 6 (six) months of the PRO plan completely free.
5.2 Eligibility
To be eligible for the Early Adopter benefit, you must:
- Download the app during the Beta period through the official website or app stores;
- Create an account in the app during the Beta period;
- Have not used the benefit previously.
5.3 Activation and Duration
The benefit is automatically activated when you create your account during the Beta period. No credit card or promo code is required. The 30 days are counted from the account creation date.
5.4 After the Free Period
At the end of the 30 days of free PRO:
- Your account automatically changes to the FREE plan;
- There is no automatic charge;
- You can choose to subscribe to the PRO plan at any time;
- Accumulated referral points remain on your profile.
5.5 Limitations
The Early Adopter benefit is personal and non-transferable. Each person can use this benefit only once. Attempts to create multiple accounts to obtain the benefit repeatedly may result in cancellation of the benefit and/or termination of accounts.
6. Referral Program
6.1 Description
The Referral Program ("Refer and Earn") allows Monely users to invite friends and earn points for the ranking.
6.2 How it Works
When referring a friend using your unique referral code, you earn points as your friend progresses in the app:
- Friend creates account: +50 points;
- Friend engages (20 records): +100 points;
- Friend subscribes to PRO: +200 points;
- Friend refers someone (cascade): +200 points.
6.3 Points Accumulation
- There is no limit on referrals;
- Points are cumulative and count towards the ranking;
- Points do not expire;
- You can unlock achievements and level up in the ranking.
6.4 Restrictions
We reserve the right to cancel points obtained through:
- Creating fake accounts;
- Self-referral (referring yourself);
- Any form of fraud or abuse of the program.
7. Registration and User Account
7.1 Account Creation
To use Monely, you must create an account providing true, complete and up-to-date information. You can sign up through:
- Email and password;
- Google account (Google Sign-In);
- Apple account (Sign in with Apple).
7.2 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your access credentials;
- All activities performed on your account;
- Notifying us immediately of any unauthorized use;
- Keeping your registration data up to date.
7.3 One Account per Person
Each person can have only one account on Monely. Duplicate accounts may be terminated without prior notice.
8. Acceptable Use
8.1 You Agree to:
- Use the Service only for personal and legal purposes;
- Provide true and accurate information;
- Respect intellectual property rights;
- Keep your access credentials secure;
- Comply with all applicable laws and regulations.
8.2 You Agree NOT to:
- Use the Service for any illegal or unauthorized purpose;
- Attempt to access other users' accounts;
- Interfere with or disrupt the operation of the Service;
- Use robots, scrapers or other automated tools;
- Transmit viruses, malware or malicious code;
- Collect information from other users without authorization;
- Resell, sublicense or commercially exploit the Service;
- Reverse engineer the application;
- Create fake or multiple accounts;
- Use the Service for money laundering or fraudulent activities.
9. Your Data and Content
9.1 Data Ownership
You retain all rights to the financial data you enter in Monely. We do not claim ownership of your personal or financial information.
9.2 License of Use
By entering data in Monely, you grant us a limited, non-exclusive and revocable license to process, store and display that data to provide the Service to you. This license includes the display of profile data (username and profile photo) to other users in the context of social features of the app, such as rankings.
9.3 Data Accuracy
You are responsible for the accuracy of the information you enter. Monely does not verify the accuracy of entered financial data and is not responsible for decisions made based on that information.
9.4 Backup and Export
Although we perform regular backups, we recommend that you keep copies of your important data. You can export your data at any time through the app settings.
9.5 Social Features and Rankings
Monely may offer social features, such as rankings and leaderboards, in which your profile information (username and profile photo) is displayed to other users of the app.
By using Monely and participating in these features, you:
- Authorize the display of your username and profile photo to other users in the context of rankings and community features;
- Grant image usage authorization for display purposes within the app;
- Acknowledge that detailed financial data (amounts, transactions, categories) is not shared in rankings;
- May request the removal of your data from rankings at any time by contacting us or adjusting privacy settings in the app.
9.6 Artificial Intelligence Features
Monely offers optional features that use artificial intelligence (AI), including an AI chat assistant and personalized financial insights.
By using these features, you acknowledge and agree that:
- Prior consent: the use of AI features requires your explicit consent, requested within the app before first use. Without this consent, AI features will not be activated;
- Shared data: messages, images, audio, financial transaction data (amounts, categories, dates) and photos of receipts or documents may be sent for processing by third-party AI providers;
- AI providers: your data is processed by Google (Gemini AI) as the primary provider and OpenAI as the fallback provider. These providers do not use your data to train AI models;
- Nature of responses: AI-generated responses and insights are for informational purposes only and do not constitute financial, tax or investment advice. You are responsible for your own financial decisions;
- Accuracy: AI-generated responses may contain inaccuracies. Monely does not guarantee the accuracy, completeness or suitability of AI-generated content;
- Revocation: you may revoke your consent at any time in the app settings, which will disable AI features without affecting other Monely features.

10. Intellectual Property
10.1 Monely Rights
Monely, including its design, source code, logos, trademarks, texts, graphics and other elements, are the exclusive property of Monely or its licensors and are protected by intellectual property laws.
10.2 Limited License
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Monely app, exclusively for personal purposes and in accordance with these Terms.
10.3 Restrictions
You may not copy, modify, distribute, sell, rent, sublicense, decompile, reverse engineer or create derivative works of Monely without our express written authorization.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee that:
- The Service will function uninterrupted or error-free;
- The results obtained will be accurate or reliable;
- Defects will be corrected;
- The Service will meet your specific expectations;
- The Service will be available at all times or locations.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Monely will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use or other intangible losses;
- Our total liability will not exceed the amount paid by you in the last 12 (twelve) months or, if the Service is free, R$ 100.00 (one hundred reais);
- We are not responsible for financial decisions you make based on information displayed in the app;
- We are not responsible for failures resulting from third-party services.
13. Indemnification
You agree to defend, indemnify and hold harmless Monely, its directors, employees, partners and service providers from any claims, damages, obligations, losses, costs or expenses (including attorney fees) arising from:
- Your use of the Service;
- Violation of these Terms;
- Violation of third-party rights;
- Content you enter into the Service.
14. Suspension and Termination
14.1 By You
You can terminate your account at any time through the app settings or by contacting us. After termination, your data will be treated according to our Privacy Policy.
14.2 By Us
We may suspend or terminate your account, at our discretion, if:
- You violate these Terms;
- You provide false information;
- Your use poses a security risk to the Service or other users;
- We are required by law;
- We decide to discontinue the Service.
14.3 Effects of Termination
After account termination, you will lose access to the Service and stored data. We recommend exporting your data before requesting termination.
15. Modifications to the Terms
We may modify these Terms at any time. When we make significant changes:
- We will post the new Terms in the app and on the website;
- We will notify you through the app and/or email;
- We will indicate the date of the last update.
Continued use of the Service after changes constitutes your acceptance of the new Terms. If you do not agree with the changes, you should stop using the Service and terminate your account.
16. Modifications to the Service
We reserve the right to, at any time and without prior notice:
- Modify, update or discontinue features;
- Add new features (free or paid);
- Change technical requirements;
- Discontinue the Service (with at least 30 days notice).
17. Communications
By creating an account, you agree to receive electronic communications from Monely, including:
- Verification and security codes;
- Notifications about scheduled payments;
- Notices about changes to the Terms or Service;
- Information about new features (optional).
You can manage your communication preferences in the app settings.
18. General Provisions
18.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Monely regarding the use of the Service.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18.3 Waiver
Monely's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
18.4 Assignment
You may not assign or transfer your rights under these Terms without our authorization. We may assign our rights at any time without notice.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil.
To resolve any controversy arising from these Terms, the jurisdiction of the user's domicile is elected, as established by the Consumer Defense Code (Law No. 8.078/1990).
